What Is Battery Under California Law?


Battery occurs when someone willfully and unlawfully uses force or violence against another person. Unlike assault, battery requires actual physical contact — even if it’s just a light touch or shove.

  • Up to 6 months in county jail, and/or
     
  • Fines up to $2,000, and/or
     
  • Probation

  • The victim is a protected person (police officer, firefighter, etc.), or
     
  • There are prior convictions or special circumstances.
     

Felony battery carries stiffer penalties, including potential state prison time.
