Burglary

What Is Burglary?


Under Penal Code § 459, burglary means entering a room, home, business, or vehicle with the intent to commit theft or any felony. You do not need to actually steal something to be charged.


Two Types of Burglary


First-Degree (Residential)


Entering an inhabited home.


  • Always a felony
     
  • Possible state prison time
     

Second-Degree (Commercial/Vehicle)


Businesses, storage units, locked vehicles, etc.


  • Can be misdemeanor or felony
     
  • Punishment varies based on circumstances
