Robbery

California Robbery (PC 211)

What Is Robbery?


Under Penal Code § 211, robbery means taking property from someone’s person or immediate presence, against their will, using force or fear.


Robbery is always a felony in California.


Types of Robbery


First-Degree Robbery


Usually charged when the alleged robbery involves:


  • An inhabited home
     
  • A driver or passenger of a vehicle
     
  • A person using an ATM
     

Second-Degree Robbery


All other robbery situations.
